General terms of use

1. Purpose

1.1 Intrepid Groupe SA, [address], Switzerland (hereinafter "Intrepid"), operates the online platform Mechadirect.ch (hereinafter "the Platform"), allowing the connection between private individuals (hereinafter "the Clients") and automotive professionals (hereinafter "the Partners").1.2 The Platform allows in particular:

the submission of requests relating to automotive services;
the receipt of quotes proposed by Partners;
the connection between Clients and Partners;
the facilitation of communication between the parties.

1.3 These General Terms and Conditions govern the use of the Platform by the Clients.1.4 By using the Platform, the Client declares that they have read these General Terms and Conditions, accept them without reservation, and are at least 18 years old and have legal capacity.

2. Conclusion and content of the contract

2.1 The Client may submit a request describing the problem encountered or the desired service. The Partners may respond to this request by drawing up one or more quotes. The Client is free to accept or refuse any quote, without obligation. The service contract is concluded directly between the Client and the Partner. Intrepid is not a party to this contract and assumes no role as a service provider. The Client acknowledges that the Platform is limited to facilitating the connection.

3. Role of the Platform

3.1 Intrepid acts exclusively as an intermediary and does not perform any automotive services, does not exhaustively select the Partners, and does not systematically check the information provided.3.2 Intrepid does not guarantee in any case:

the receipt of quotes;
the quality of the services;
the solvency of the Partners;
the relevance or accuracy of the quotes.

3.3 The Platform may modify, suspend, or interrupt its services at any time.

4. Client Obligations

4.1 The Client undertakes to provide complete, accurate, and up-to-date information regarding:

the vehicle;
the problem encountered;
the relevant circumstances.

4.2 The Client undertakes in particular to:

respond to requests for information from the Partners;
cooperate in the proper execution of the services;
respect the agreed appointments.

4.3 The Client bears the consequences of inaccurate or incomplete information.4.4 The Client undertakes not to use the Platform in an abusive or fraudulent manner and not to transmit illicit or misleading content.

5. Quotes and services

5.1 Quotes are established freely by the Partners.5.2 Quotes may be indicative and subject to adjustments after inspection of the vehicle.5.3 Any service is executed under the exclusive responsibility of the Partner.5.4 The Client is responsible for verifying the content of the quotes before acceptance.

6. Price and payment

6.1 Prices are set freely by the Partners.6.2 Payment terms are agreed directly between the Client and the Partner, unless otherwise stated.6.3 Intrepid does not intervene in the financial flows between the parties.6.4 The Client is responsible for the full payment of the services.

7. Modification and cancellation

7.1 Modifications or cancellations must be agreed directly with the Partner.7.2 Intrepid is not responsible for the financial consequences of these modifications.

8. Liability

8.1 Intrepid declines all liability regarding the services performed, damages caused to the vehicle, diagnostic errors, and disputes between the Client and the Partner.8.2 Intrepid is not responsible for the information provided by the Clients, Platform interruptions, and indirect or consequential losses.8.3 Any dispute relating to a service must be settled directly between the Client and the Partner. Intrepid is not a party to these disputes and assumes no liability in this respect. Intrepid may, on a purely optional basis and without obligation, intervene to facilitate an amicable resolution.

9. User account

9.1 The use of the Platform may require the creation of an account. The Client is responsible for the use of their account.9.2 In the event of a violation of these General Terms and Conditions, abusive use of the Platform, or unlawful behavior or behavior contrary to good morals, Intrepid reserves the right, at its sole discretion, to:

suspend or delete the Client's account;
refuse access to all or part of the Platform;
delete any content or request.

9.3 No compensation may be claimed in this respect.

10. Data protection

10.1 All data provided to Intrepid Groupe SA by the Client or other persons concerned by the process are processed in accordance with the provisions of the Swiss Federal Act on Data Protection (FADP) and the EU General Data Protection Regulation (GDPR), where applicable.10.2 Intrepid Groupe SA solely uses the email address to offer the Client similar services. The Client may object at any time to this use of their email address without incurring any costs other than transmission costs according to the basic rates.10.3 Client data is only transmitted to partners for the purpose of executing the respective requests.

11. Intellectual property

11.1 All rights to the information, elements, and content of the platform, including the copyright, trademarks, and designations contained therein, are the property of Intrepid Groupe SA.

12. Applicable law and jurisdiction

12.1 These general terms and conditions are subject to Swiss law.12.2 The place of jurisdiction for all disputes between Intrepid Group SA and the Client is the company's registered office.

13. Nullity or partial nullity; language

13.1 The nullity or partial or total invalidity of one or more provisions of these general terms and conditions does not affect the validity of the other provisions. Any invalid provisions or provisions that have become invalid must be replaced, when applying the contract, by provisions that come as close as possible to the objective pursued by the invalid provisions.
